Eligibility: The Breeders' Cup 25 Sweepstakes (hereafter, "Sweepstakes") is open to legal residents of the 50 United States and the District of Columbia and Canada (excluding Quebec) who are 18 years of age or older as of the date of entry. Employees, officers, directors, agents and representatives of Breeders' Cup Ltd. ("Sponsor"), Conover Tuttle Pace, Project Support Team, Inc., their respective parents, affiliates, subsidiaries, retailers, distributors, suppliers, advertising, promotion and public relations agencies (hereafter collectively, "Released Parties"), and each such individual's immediate family member (mother, father, sister, brother, any child, husband, wife and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related, are not eligible to participate or win a prize. Void in Quebec and where prohibited by law. All applicable federal, local and provincial laws apply.
How to Enter: Visit www.breederscup.com between 12:00:00 p.m. (noon) Eastern Time ("ET") on July 31, 2008 and 11:59:59 a.m. ET on October 6, 2008 (the "Promotion Period") and follow the instructions to complete and submit the Official Entry Form. All entries become the property of Sponsor and will not be returned. Only one (1) entry per person/per household address per e-mail address will be accepted per day. In case of multiple entries on any day from any one person or household address or e-mail address, only the first entry on such day will be accepted. The use of script, macro or automated devices (or any other devices intended to automate any aspect of entry) to enter Sweepstakes is prohibited and any entry through such means and any entry that is deemed to be ineligible (at Sponsor's sole discretion and in accordance with these Official Rules) will be void. In the event of a dispute as to the identity of an entrant based on the e-mail address submitted, entry will be awarded to the person named on the applicable online entry form (regardless of whether that is the name of the authorized account holder of the email address from which said entry form was submitted) provided such individual is eligible according to these Official Rules. Released Parties are not responsible for late, lost, stolen, incomplete, misdirected, delayed, garbled, inaccurate, or undelivered entries or messages or for telephonic, human or computer failures, problems or errors, interruptions in service due to system upgrades, repairs, modifications or other causes, failures or malfunctions of connections, satellite, network, cable, Internet Service Provider (ISP), phones, phone lines or telephone systems, traffic congestion on the internet, technical or mechanical malfunctions, or other malfunctions or errors, whether caused by equipment, programming, human error or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors which may occur in connection with the administration of the Sweepstakes, the processing of entries or the announcement of the prizes; or for any injury or damage to entrant's or any other person's computer relating to or resulting from participation in this Sweepstakes, or for printing, typographical, human or other errors appearing in these Official Rules or other Sweepstakes-related materials. Sponsor reserves the right, in its sole discretion, to disqualify any entrants whom Sponsor believes have attempted to tamper with or impair the administration, security, fairness or proper play of this Sweepstakes or is in violation of these Official Rules and void all associated entries.
Winner Selection: The potential Grand Prize winner will be selected in a random drawing conducted on or about October 8, 2008 from among all eligible entries received by Project Support Team, Inc., an independent judging organization. By participating, entrants agree to these Official Rules and to the decisions of the Sponsor and judges, which will be final and binding in all respects. Potential winner will be notified at the telephone number provided in his/her entry. If initial potential winner does not answer the phone (or is otherwise unavailable during initial contact attempt), a message will be left including a phone number which potential winner must call to claim his/her prize within twenty-four (24) hours of the message being left. Other than the one (1) message, no further attempt to contact such individual will be made. If a potential winner fails to claim his/her prize in the allotted time, such individual will be disqualified and an alternate potential winner may be chosen, time permitting and at Sponsor's sole discretion. If the potential winner is a resident of Canada (excluding Quebec), he/she must correctly answer a time-limited mathematical skill-testing question administered by the Sponsor or judges without assistance or mechanical or electronic aid in order to be eligible to win the prize. Odds of winning depend upon the total number of eligible entries received.
(1) Grand Prize: 5-Day/4-Night trip for winner and one (1) guest to Los Angeles, CA to attend the 2008 Breeders' Cup World Championships being held at Oak Tree at Santa Anita in Arcadia, CA currently scheduled for October 24, 2008 – October 25, 2008. Trip includes round trip coach air transportation from major gateway airport nearest winner's residence, one (1) standard double-occupancy hotel accommodations for four (4) nights, round trip ground transportation to and from the racetrack for both days' events, 2 tickets for both the October 24, 2008 and October 25, 2008 events, a tour of the racetrack's backstretch, admittance for two (2) into a VIP party and a Breeders' Cup Gift Bag for winner only. Approximate Retail Value ("ARV") = $8,500. Actual value may vary based on location of winner's residence. Any difference between the stated ARV and the actual value, if any, will not be awarded. Exact contents of gift bag are at Sponsor's sole discretion. If winner resides within a 100-mile radius of Los Angeles, CA, ground transportation may be provided in lieu of air transportation and no compensation or substitution will be provided for difference in prize value. Trip must be taken on date(s) designated by Sponsor or prize will be forfeited in its entirety and, at Sponsor's discretion and if time permitting, awarded to an alternate winner. Travel and accommodation restrictions and other restrictions may apply. Winner and his/her guest must travel together on same itinerary and are responsible for obtaining all required travel documents, including passports and visas (as applicable). All travel arrangements must be made through travel agent of Sponsor's selection on a carrier of Sponsor's choice. Released Parties are not responsible for travel delays or cancellations. Costs and expenses associated with the acceptance and use of the prize not specified herein as being awarded as part of prize, including, but not limited to, federal, state and local taxes, if any, and food, beverages, airline luggage charges and travel expenses for winner are winner's sole responsibility. All prize details are at Sponsor's sole discretion. In the event the Championship is postponed, trip will be rescheduled. In the event the Championship is postponed and not resumed, no compensation or substitution will be provided; however, remainder of prize package minus the Championship prize elements will be awarded and Sponsor will have no further obligation to winner. Tickets are subject to terms and conditions specified thereon. Seat locations will be determined by Sponsor. Winner and guest must comply with all venue rules and regulations. Failure to do so may result in forfeiture of such portion of the prize and removal from event. Released Parties reserve the right to remove or to deny attendance to winner and/or guest who engages in a non-sportsmanlike, disruptive or inappropriate manner, or with intent to annoy, abuse, threaten or harass any other person at any event or party or during any activity. Unused tickets cannot be refunded, exchanged or applied towards tickets or passes for any subsequent event. If unused, tickets cannot be returned, refunded or exchanged for cash value or substitute tickets or passes.
Miscellaneous: No transfer, assignment, cash redemption, or substitution of prize (or portion thereof) except by Sponsor who reserves the right to substitute prize (or applicable portion thereof) of comparable or greater value as determined by Sponsor. Potential Grand Prize winner will be required to execute and return an Affidavit of Eligibility, Liability and Publicity Release (where legal) within 5 days of date of issuance of notification. Grand Prize winner's guest will be required to execute a Liability and (where legal) Publicity Release prior to the issuance of travel documents. Guest must be of legal age of majority in his/her jurisdiction of residence (and at least 18) unless he/she is the child or legal ward of the Grand Prize winner. If guest is the child or legal ward of the Grand Prize winner, Grand Prize winner must sign and return a Liability and (where legal) Publicity Release on behalf of such child or legal ward. Non-compliance with any of the foregoing, with these Official Rules or return of prize notification as non-deliverable may result in disqualification and, at Sponsor's discretion and if time permitting, an alternate winner being selected. Entrants agree, by entering, that 1) Sponsor and its designees may use (unless prohibited by law), entrant's name, city and state of residence, photograph and/or likeness for advertising, trade and/or any other purposes in any media now or hereafter known throughout the world in perpetuity, without further compensation, permission or notification, and 2) the Released Parties shall have no liability and will be held harmless by entrant for any claim, action, liability, loss, injury or damage to entrant or any other person or entity, including, without limitation, personal injury or death to entrant or any other person or damage to personal or real property, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of the prize and any travel or travel-related activity thereto (including, but not limited to, travel to and from and attendance at the Championship and any other event or party) or participation in this Sweepstakes. Sponsor reserves the right, in its sole discretion, to modify, suspend, and/or terminate this Sweepstakes should virus, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or proper play of the Sweepstakes and, in the case of suspension or termination, at its discretion, select winner from eligible non-suspect entries received prior to event requiring such termination or suspension. CAUTION: Any attempt to deliberately damage the website or undermine the legitimate operation of this Sweepstakes is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages (including attorneys' fees) and/or other remedies from any such person(s) responsible for the attempt to the fullest extent permitted by law.
